First Responder COVID-19 Guide

Welcome to Stanford Medicine’s First Responder and Essential Worker COVID-19 Guide Application (the “Application”).  Stanford Medicine offers the Application and its related services (“Services”) to you subject to your compliance with the terms, conditions, and notices (“Terms”) set forth below.     

The Application offers a screening tool for symptom evaluation, and directs users to resources and information regarding the COVID-19 pandemic. The Application utilizes symptoms you enter to determine your general priority to be tested. The Application and related services do not create a relationship between you and a health care provider. The Application does not send assessments to health care providers automatically   If you have a health emergency, please dial 9-1-1 or visit your local emergency department. Always check with a doctor before making medical decisions

Your Permission to use the Services

Stanford Medicine grants you limited personal permission to use the Services in accordance with these Terms.  You agree not to transmit content that you do not have the right to transmit or that infringes the right of any party, and you agree to use the Services in compliance with all applicable laws.  You understand the that the Services may be subject to patent, copyright, trademark or other intellectual property protection and that the ownership of software and other intellectual property related to the Services, as well as the goodwill associated therewith remains with Stanford Medicine or its licensors.  You agree that any improvements or other changes to the Services itself are the sole property of Stanford.  Your permission to use the Services is limited in a number of ways. Any commercial use, such as selling content, creating course packs, or posting information elsewhere, is prohibited.

Your permission terminates immediately, without any further action by Stanford Medicine, if you breach these Terms. You may not transfer or assign your permission to any other party.

Stanford Medicine is the owner or licensee of all rights in the Application, its content, software, and related services. You have no right to such content, software or services if not expressly granted in these Terms. “Stanford Medicine” and the logos or other proprietary marks of Stanford Medicine’s licensors and partners are trademarks of Stanford Medicine or its licensors and partners. No right, title or interest in those trademarks is granted you in these Terms.

The Application and related services are provided “As Is.”

SERVICES PROVIDED THROUGH AND INFORMATION CONTAINED IN THE APPLICATION ARE PROVIDED AS IS AND AS AVAILABLE. STANFORD MEDICINE MAKES NO, AND HEREBY DISCLAIMS ANY, WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF TITLE, NONINFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR USE OR PURPOSE.  FURTHER, STANFORD MEDICINE DISCLAIMS ANY WARRANTY THAT THE PROGRAM WILL BE AVAILABLE AT ALL TIMES OR WILL OPERATE WITHOUT INTERRUPTION OR ERROR. STANFORD MEDICINE MAKES NO WARRANTY AS TO THE RELIABILITY, ACCURACY, TIMELINESS, USEFULNESS, ADEQUACY, COMPLETENESS OR SUITABILITY OF THE PROGRAM OR INFORMATION PROVIDED THROUGH THE PROGRAM.

You agree to be solely responsible for your use of the Services.

STANFORD MEDICINE, ITS CONSTITUENT ENTITIES, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND INFORMATION PROVIDERS SHALL NOT BE LIABLE FOR ANY DAMAGES YOU MAY SUFFER OR CAUSE THROUGH YOUR USE OF THE SERVICES EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  STANFORD MEDICINE, ITS CONSTITUENT ENTITIES, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND INFORMATION PROVIDERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICES.  THESE LIMITATIONS SHALL APPLY WHETHER THE ASSERTED LIABILITY OR DAMAGES ARE BASED IN CONTRACT (INCLUDING, BUT NOT LIMITED TO, BREACH OF WARRANTY), TORT (INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE) OR ANY OTHER LEGAL OR EQUITABLE GROUNDS.

You agree to indemnify and hold Stanford Medicine harmless for any claims, losses or damages, including attorney’s fees, resulting from your breach of these terms or use of the Services.

This Agreement is Governed by California Law.

This Agreement shall be governed by and construed in accordance with the laws of the State of California, United States of America, as such laws would apply to a contract fully negotiated, entered into, and performed in that state.

Any Action Against Stanford Medicine Must be Brought in California.

You Agree to Arbitrate Any Dispute Between Us.  You agree that any dispute, controversy or claim arising out of or related to these Terms or your use of the Services will be resolved and settled through arbitration administered by the American Arbitration Association and conducted in Santa Clara, California, United States of America. Judgment on any award rendered by the arbitrator may be entered in any court of competent jurisdiction.

You agree that the state or federal courts located in or serving Santa Clara County, California, United States of America, shall have exclusive jurisdiction and venue over any action arising out of or relating to these Terms or your use of the Services. You waive any claim that a court located in or serving Santa Clara County, California, lacks personal jurisdiction over you, is an improper venue, or is an inconvenient forum.

Other Miscellaneous Provisions.

These Terms constitute the entire understanding between you and Stanford Medicine regarding your use of the Services. No modification or attempted modification of these Terms by you shall be binding on Stanford Medicine unless made in writing and physically signed by an authorized representative of Stanford Medicine. Stanford Medicine may modify these Terms at any time.

Notices sent to you by Stanford Medicine in connection with these Terms or your use of the Services may be delivered to you by electronic mail or a general notice on the Services. You may give notice to Stanford Medicine at any time by letter delivered by first class postage prepaid U.S. mail or overnight courier to the following address:

These Terms are severable to the extent any term is deemed invalid, illegal or unenforceable.

Stanford Medicine’s failure to enforce any provision of these Terms shall not be deemed a waiver of that or any other provision of these Terms.

Stanford Medicine may update these Terms from time to time.  We may notify you of changes to the Terms through email or other forms of communication.  Even if we do not notify you, it is your obligation to check the Terms for changes.    Your use and continued use of the Application and related services reflects your agreement to these Terms and any modifications of these Terms made by Stanford Medicine.
